Terms of Use

These terms apply when you use the Atwater app (“Atwater”, “we”, “us”). By using Atwater, you agree to them. If you don’t agree, please don’t use the app. Our Privacy Policy explains how we handle your information.

1. Estimates only

Atwater helps you keep a log of what you eat. Its numbers come from nutrition labels, food databases, restaurants’ published information and AI estimates, and they can be wrong. Photo and restaurant estimates are marked “Estimated” for a reason: portions and recipes vary. Check the numbers before you rely on them, and use the package label when you have it.

The smart features use AI (Anthropic’s Claude). AI can misread a photo or misunderstand what you typed, so look over what it adds to your log.

2. Not medical advice

Atwater isn’t a medical device and doesn’t give medical, nutritional or health advice. Its calorie and protein targets are general estimates from common formulas, not a prescription. Talk to a doctor or registered dietitian before changing how you eat, especially if you’re pregnant or breastfeeding, have a medical condition, take medication, or have a history of disordered eating. If something feels wrong, stop and get professional help.

3. Who can use Atwater

You must be at least 13 years old to use Atwater. If you’re under 18, please use it with a parent’s or guardian’s permission.

4. Your account

You can use Atwater without an email, or save your log to an email address. Keep access to your phone and email secure, since a sign-in code sent to your email opens your log. You can delete your account at any time, as explained in the Privacy Policy.

5. Free and Pro plans

Atwater is free to use, with daily limits on the smart features (like photos and AI food logging). Barcodes, Quick add, Same as yesterday, typing numbers yourself and saved restaurants have no daily limit. We may adjust limits to keep the service running well, and the app always shows how many uses you have left. When demand is unusually high, smart features may pause for a while; everything else keeps working.

Atwater Pro is an optional subscription with higher daily limits: $4.99 per month or $29.99 per year (US prices; your local price is shown in the app before you buy). Pro isn’t available yet. When it is:

• Subscriptions are bought and billed through your Apple ID. Payment is charged when you confirm the purchase.
• A subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within 24 hours before the period ends.
• You can manage or cancel your subscription in your iPhone’s Settings → your name → Subscriptions. Canceling stops future renewals; you keep Pro until the end of the period you paid for.
• Refunds are handled by Apple under Apple’s policies. We can’t issue refunds directly.
• Deleting your Atwater account doesn’t cancel a subscription. Cancel it with Apple first.

6. Using Atwater fairly

Please don’t:

• try to get around daily limits, or use automated tools or scripts with the app or its server;
• use Atwater’s server or AI features for anything other than logging food;
• interfere with the service, or try to access other people’s data;
• use Atwater in a way that breaks the law.

We may suspend or close accounts that do these things.

7. Shared food information

When Atwater reads a product’s nutrition numbers from a label photo or finds a product or restaurant menu online, that food information may be shared with other users so they get it faster. You let us use and share that food information (never your personal information) for this purpose.

8. Changes to Atwater

We’re always improving Atwater, so features may change, and some may be added or removed. We may update these terms; when we do, we’ll change the date at the top, and for important changes we’ll let you know in the app. Using Atwater after a change means you accept the updated terms.

9. No guarantees

Atwater is provided “as is” and “as available”. To the fullest extent the law allows, we don’t promise that it will be accurate, error-free or always available, and we aren’t responsible for decisions you make based on its numbers or for indirect or consequential losses. Nothing in these terms limits rights you have under consumer laws that can’t be waived.

10. Apple

If you downloaded Atwater from the App Store, Apple’s Licensed Application End User License Agreement also applies. These terms are between you and us, not Apple, and Apple isn’t responsible for the app or its support.
